These Terms & Conditions ("Terms") constitute a legal agreement outlining your rights and obligations, as well as those of UserCRO, Inc. (doing business as DeckFusion) ("UserCRO", "DeckFusion", "we", "us", or "our"), a company registered in the state of Delaware, USA. These Terms govern your use of the DeckFusion website (the "Site") and our data storytelling services (the "Services") offered through it.

Acceptance of Agreement

‍By accessing our Site or using our Services, you agree to comply with and be bound by all terms and conditions herein (the "Agreement"). Please review these Terms carefully. If you disagree with any part of these Terms, you should refrain from using our Site or Services. We reserve the right to update or revise these Terms at our discretion. Description of Services

UserCRO, Inc., operating as DeckFusion, provides analysis across connected data sources, makes recommendations for improvement, including information from third-party benchmarking sources, and visualizes results into presentation slides. Our Services are designed to create compelling, data-driven narratives quickly and efficiently. By using our Services, you acknowledge that you understand the nature of our offerings and agree to use them in accordance with these Terms.

Intellectual Property Rights

UserCRO, Inc. (dba: DeckFusion) retains all rights, title, and interest, including all related intellectual property rights, in and to our technology, content, Services, and any suggestions, ideas, enhancement requests, feedback, recommendations, or other information provided by you or any other party relating to DeckFusion. The DeckFusion name, logo, and product names are trademarks of UserCRO, Inc. or third parties, and no right or license is granted to use them without our express written consent.

You do not acquire ownership rights to any content, document, or other materials viewed through or created using DeckFusion Services. The posting of information or materials on DeckFusion does not constitute a waiver of any right in such information and materials.

User Content and Data

You retain all rights to any data, information, or material that you submit to DeckFusion ("User Content"). By using our Services, you grant UserCRO, Inc. (dba: DeckFusion) a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of providing and improving our Services.

You are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use any and all User Content that you submit. UserCRO, Inc. (dba: DeckFusion) is not responsible for the deletion, correction, destruction, damage, loss, or failure to store any User Content.

Your Responsibilities

You agree to:

1. Provide accurate and complete information when using our Services.
2. Use our Services only for lawful purposes and in accordance with these Terms.
3. Not use our Services in any way that could damage, disable, overburden, or impair our servers or networks.
4. Not attempt to gain unauthorized access to any part of our Services, other accounts, or computer systems or networks connected to our Services.
5. Not use our Services to create presentations or content that is false, misleading, or violates any third-party rights.

Payment Terms

Payment for our Services is required in advance. We offer flexible billing options including monthly, quarterly, or yearly plans. All fees are non-refundable. There will be no refunds or credits for partial periods of service, upgrade/downgrade refunds, or refunds for unused periods with an open account.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.

Cancellation and Termination

You may cancel your account at any time through your account settings on our Site. Upon cancellation, your User Content will be immediately deleted from our Services and cannot be recovered.

UserCRO, Inc. (dba: DeckFusion) reserves the right to suspend or terminate your account and refuse any and all current or future use of the Services, for any reason at any time, at our sole discretion.

Disclaimer of Warranties

UserCRO, Inc. (dba: DeckFusion) provides its Services on an "as is" and "as available" basis. We do not warrant that our Services will be uninterrupted, timely, secure, or error-free. We make no representations about the accuracy, reliability, completeness, or timeliness of the content created through our Services.

Limitation of Liability

In no event shall UserCRO, Inc. (dba: DeckFusion) be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

You agree to indemnify, defend, and hold harmless UserCRO, Inc. (dba: DeckFusion), its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:

1. Your use of the Services;
2. Your violation of these Terms;
3. Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
4. Any claim that your User Content caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Services.‍

Data Breach Limitation

You agree that UserCRO, Inc. (dba: DeckFusion) shall not be held liable for any damages resulting from a data breach, cyber attack, or other unauthorized access to our systems or your data. While we implement industry-standard security measures, we cannot guarantee absolute security of your information.

Damage Cap

Notwithstanding anything to the contrary in these Terms, you agree that your sole and exclusive remedy for any dispute with us is to discontinue use of the Services. In no event shall your recoverable damages exceed the total amount you have paid for the Services in the twelve (12) months preceding the incident giving rise to the claim.

Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "last updated" date at the top of this document. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
